Shipping Terms and Conditions

The Alcove strives to ship every order as soon as possible, however, you hereby acknowledge and agree that the Company is not responsible nor liable in any way for delays in the shipment of your order caused by stock limitations, manufacturing delays, and/or force majeure.  The Company does not guarantee the delivery time of any order and has the right to change the shipping carrier.   We ship to all States in the continental United States.  Orders are usually shipped within three (3) business days from the date the order is placed.  In the event that the shipping date is later than fourteen (14) business days, the Company will contact you and inform you of the expected shipping time frame.

You hereby acknowledge and agree that the Company’s sole role in the shipping of your order is to procure shipping services on your behalf and arrange the shipment of your order on your behalf.  For that purpose you hereby grant the Company the right to choose the freight carrier or shipper and share with the freight carriers and shipping companies your order information.  The Alcove reserves the right to change and/or modify the shipper and/or shipping method at their discretion for ease of delivery.

Delivery and pick-up returns to remote locations:  All freight (LTL carrier) deliveries can only be delivered to locations on paved roads.  Failure to notify The Alcove prior to placing an order to delivery to said locations with unpaved roads/small access bridges, weight restricted access roads, etc., will result in the customer paying for any additional charges for reconsignment/delivery; this also applies to all returns and unwanted orders.  All returns must also be returned in the same condition as delivered, shrink-wrapped and on pallets.  The customer is responsible for any additional charges incurred to re-palletize, shrink wrap, and relocating the material to a pick-up location where the order was originally left by the carrier so that the a freight truck can pick-up the return.  The customer must contact The Alcove for all returns prior to moving a returned order to a paved location (the original drop location).  Freight trucks will NOT deliver to nor pick-up from non-paved road locations.  Please note, all additional charges as mentioned above, for returned products will be deducted from the return refund after the return is received at the warehouse.

When an order is shipped via LTL (Less Than Truckload) carrier, The Alcove is not responsible for any storage fees that result from the Buyer not being available to accept the delivery in a timely manner. The LTL carrier will allow 3 days free storage, after that a storage fee of $50.00/day will apply. The Buyer is responsible for all storage fees and these must be paid in full prior to the delivery of the order.  If the customer fails to respond to telephone calls to schedule delivery The Alcove will attempt to contact by phone and email.  If after three failed attempts to contact the Customer the order will be returned to the shipping warehouse.  The Customer is responsible for all shipping fees from and to the warehouse as well as a 25% restocking charge fee.

All orders placed on our website and shipped via LTL carrier (such as Estes Express, R&L Carriers, Pitt Ohio, Central Transport, etc.) assume that they will be residential curbside delivery and the truck unless specifically noted on The Alcove's order Receipt.  Any additional requests MUST be made to The Alcove in writing prior to placing the order (such inside delivery, etc.) so that the appropriate fees can be added to the order.  If additional fees that were not authorized by The Alcove and have been invoiced by the carrier The Alcove will email the customer the said invoice for such services/fees and the customer is required to pay The Alcove within 5 business days.  If not, The Alcove will charge interest on the owed fee 1% per day.

If an order has items that come from multiple supplier's, The Alcove reserves the right to notify the customer that additional shipping costs could apply. In this case The Alcove will contact the customer via email and inform them of the additional shipping cost. The customer will have to pay the additional cost prior to shipment or The Alcove will issue a full refund to if they would like to cancel the order. You further acknowledge and agree that the Company is not a carrier nor shipper and thus does not bear any responsibility and/or liability for the shipping of your order, the timely delivery thereof and/or damages and/or expenses incurred by you in connection with such shipping.  The shipping of your order is the sole responsibility of the freight carrier, in accordance with the terms of shipping of the applicable carrier.  Thus any claim, dispute or demand regarding the shipping of your order will be taken up directly with the carrier and you hereby indemnify and hold the Company harmless from any claim, loss, damage, liability or cost asserted against or incurred by you that is related to the shipping of your order.

The Company shall obtain the applicable carrier’s acknowledgement that your order was collected by that carrier in good condition and in full at the facilities of the Company or another location designated by the Company.

The Alcove does not ship outside of the continental United States but can ship to a logistic company that the customer hires to ship overseas. It is the customer's responsibility to check the order for damaged or missing tile at time of delivery and note damage of driver's Bill of Lading. The customer shall then notify The Alcove within 24 hours of delivery of any damage/missing product and The Alcove will promptly ship replacement. The Alcove is not responsible for any tariffs, taxes or fees that could apply to such shipments.

The Alcove can not ship tile orders that have items larger than 18" via Fed Ex or UPS (except samples) due to limitations in packaging.  Please choose the LTL (less than truckload) option for these items.

The Fed Ex shipping delivery dates reflected on our website may not be accurate since we ship from numerous warehouses/factories throughout the US. Please email info@thetilealcove.com to obtain an accurate shipping time. If The Alcove does not hear from the customer it is implied that packing times of 2-3 days are acceptable.

Receiving Terms and Conditions

Immediately upon its delivery, in the presence of the carrier’s representative, you shall physically inspect the condition that your order was delivered. If there is visible damage or missing items you must note it on the carrier's paperwork, take pictures of any damaged items and then contact The Alcove within 24 hours. Please do not discard any damaged tile but give the broken tile directly to the carrier's driver and have this noted on the carrier's paperwork.  The customer agrees to take clear pictures showing any broken tile/items and email them to The Alcove.  Note that torn packaging does not constitute that the items inside are broken or damaged. THE CUSTOMER AGREES THAT THEY MUST REMOVE ANY DAMAGED/BROKEN ITEMS AND EMAIL THE PICTURE TO THE ALCOVE IN ONE PICTURE SO THE WE CAN OBTAIN AN ACCURATE COUNT FOR THE CLAIM.  Note that unless you have done so within the time frame mentioned above, your acceptance of the shipment from the carrier is an acknowledgement that the product has been delivered complete and in good condition thus relieving the carrier from any liability.

Since mosaic tiles consist of many smaller tiles with a mesh backing if any broken small tiles are noted The Alcove will send the appropriate number of sheets required to replace those individually broken tiles.

If you receive an order from Fed Ex or UPS please open and inspect the package(s) for any damage. If damaged tiles are found, do not discard the packaging or any tile. Call The Alcove to report the damage within 24 hours of receiving your order to report any damaged tile and we will send you replacement tile. In most cases Fed Ex & UPS will want you to put the damaged tile back in the original packaging and place it on your front porch where they will pick-up and ship back to us. This will assist The Alcove in it's claim with Fed Ex or UPS but please note that we will ship replacement tile immediately upon notification from the customer. 

Errors, Omissions and Changes

While the Company attempts to ensure the accuracy of all materials presented within this Site, the Company makes no warranties or representations as to its accuracy, and the user of this Site is warned that this service could include typographical errors, technical inaccuracies, and/or errors or omissions.  The Company reserves the right to make improvements and/or changes at any time and we reserve the right to make changes to our Site and these disclaimers, terms and conditions at any time.  Product prices that are listed on this Site are subject to change at the sole discretion of the Company.  In the event that a product is listed at an incorrect price or with other incorrect information due to typographical or other error, the Company has the right to refuse or cancel any orders placed for the product listed incorrectly.

Taxes

The Buyer acknowledges and agrees to pay any applicable sales, excise or other taxes to the products they purchase on this Site.  Any taxes which the Company may be required to pay or collect under any existing or future law, upon or with respect to the sale, purchase, delivery, storage, processing, use or consumption of any of the products shall be the responsibility of the Buyer.   

Applicable Law and General Terms

These Terms, any other policies or guidelines referenced herein contained in this Site constitute the entire agreement between the Company and you.

This Site is created and controlled by the Company, in the State of Connecticut, USA.  These Terms and the relationship between you and the Company will be governed by the laws of the State of Connecticut without regard to its conflict of law provisions.  You and the Company hereby expressly and freely agree to submit to the personal  and exclusive jurisdiction of the courts located within the County of Hartford, Connecticut.

The Alcove takes seriously any false allegations or slanderous comments that are posted online or via any social media forums and will prosecute in the courts located within the County of Hartford, Connecticut.

The failure of the Company to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.  If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the service or these Terms must be filed within ninety (90) days after such claim or cause of action arose or be forever barred.

If an order was entered by The Alcove representative for the customer it is up to the customer to review our Terms and Conditions as they apply whether The Alcove enters the order or if the customer enters the order.
